<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">In Austria, the employment and posting of TCNs is subject to the <a href="https://www.ris.bka.gv.at/GeltendeFassung.wxe?Abfrage=Bundesnormen&Gesetzesnummer=10008365" target="_blank" rel="noopener noreferrer">Employment of Foreigners Act</a> (AuslBG) and the <a href="https://www.ris.bka.gv.at/GeltendeFassung.wxe?Abfrage=Bundesnormen&Gesetzesnummer=20009555" target="_blank" rel="noopener noreferrer">Anti-Wage and Social Dumping Act</a> (LSD-BG), which implements Directive 96/71/EC on the posting of workers.</p><p style="margin: 0; text-align: justify;">These two acts ensure equal treatment for TCNs employed in Austria in respect of the employment conditions set out in the various labour law acts. They guarantee that posted TCNs (whether from a European Economic Area (EEA) country or a third country) benefit from key Austrian employment standards (e.g. paid annual leave, minimum wages, working hours) during postings of up to 12 months. For postings over 12 months, Austrian labour law generally applies if it is more favourable than that of the posting country.<span style="font-size:9pt;"><sup>1</sup></span></p><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;">Workers who are temporarily posted from Austria to EU/EEA countries continue to be subject to Austrian labour law, unless more favourable foreign provisions apply under EU law.<span style="font-size:9pt;"><sup>2 </sup></span>For assignments abroad lasting longer than one month, employers must provide employees with a document containing key information (e.g. destination country, duration, currency of remuneration).<span style="font-size:9pt;"><sup>3</sup></span> Austria does not impose additional labour law provisions for postings from Austria, and there are no reporting obligations in Austria (except social security).</p><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;">The term ‘posted worker’ is not explicitly defined in Austrian labour law. However, the term ‘posting’ refers to an employer temporarily sending an employee abroad to carry out work based on a contractual obligation, typically on a service contract (see Table 2).<span style="font-size:9pt;"><sup>4</sup></span></p><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;">The term ‘worker’ is not explicitly defined and is not used uniformly in Austrian labour law.
