<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">Estonian labour law is primarily regulated by the <a href="https://www.riigiteataja.ee/en/eli/529052024001/consolide/current" target="_blank" rel="noopener noreferrer"><strong>Employment Contracts Act</strong></a> (Töölepingu seadus), which determines the rights and obligations of employees and employers. The <a href="https://www.riigiteataja.ee/en/eli/526072023008/consolide" target="_blank" rel="noopener noreferrer"><strong>Working Conditions of Employees Posted to Estonia Act</strong></a> (Eestisse lähetatud töötajate töötingimuste seadus) transposes the Posting of Workers Directive into national legislation. The <a href="https://www.riigiteataja.ee/en/eli/518032025012/consolide" target="_blank" rel="noopener noreferrer"><strong>Occupational Health and Safety Act</strong></a> (Töötervishoiu ja tööohutuse seadus) sets out OSH requirements.&nbsp;</p><p style="margin: 0; text-align: justify;"><br>Estonian labour law:</p><p style="margin: 0; text-align: justify;">&nbsp;</p><ul style="list-style-position: inside;"><li data-list-item-id="e9705197054b32491fe1f2e141573b5d4"><p style="margin: 0; text-align: justify;">Ensures that posted workers must be guaranteed certain <strong>working conditions</strong> outlined in Estonian law, including provisions on working time, rest periods, remuneration, annual leave, equal treatment, temporary agency work, and compensation for business trip expenses.</p></li><li data-list-item-id="ebb046cba0a033f55ffff132523b143e4"><p style="margin: 0; text-align: justify;"><strong>Defines an employee</strong> as a natural person who does work for another person (the employer) in subordination to the management and control of the employer based on an employment contract. The employer is obliged to pay remuneration for the work performed (<a href="https://www.riigiteataja.ee/en/eli/529052024001/consolide/current" target="_blank" rel="noopener noreferrer"><strong>Employment Contracts Act</strong></a>).</p></li><li data-list-item-id="e9b6b81f2a573b3a6a3da7819de19340e"><p style="margin: 0; text-align: justify;"><strong>Defines a posted worker</strong> as a natural person who usually works in an EU or European Economic Area (EEA) Member State, or Switzerland, on the basis of an employment contract, and whom the employer posts to work in Estonia for a specified period of time for the provision of a service. This includes situations where the employee posted by their employer to work in Estonia: i) works at the employer’s expense and under their management and supervision, based on a contract between the employer and a contracting entity or authority operating in Estonia; ii) is working in the employer’s branch or in a company belonging to the same group as the employer; or iii) is posted by an employer who is a legal person or sole proprietor that intermediates temporary workforce (Working Conditions of Employees Posted to Estonia Act).</p></li><li data-list-item-id="ec9447dc1445d206da1400dc737eae3f7"><p style="margin: 0; text-align: justify;"><strong>Ensures </strong>that posted workers, including TCNs, benefit from equal treatment in core employment conditions.</p></li></ul></div>
