<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">Articles 108-109 of the <strong>Labour Code</strong><sup>1 </sup>regulate the posting of workers to Lithuania. They incorporate The Posting of Workers Directive, Directive 2018/957/EU) and Directive 2014/67/EU (Enforcement Directive).&nbsp;</p><p style="margin: 0; text-align: justify;"><br><strong>These articles apply to employers from all foreign countries, including those from non-EU countries</strong>, ensuring that posted workers from third countries receive equal treatment in respect of employment conditions while working in Lithuania.</p><p style="margin: 0; text-align: justify;"><br>Articles 108-109 of the <strong>Labour Code</strong>:</p><p style="margin: 0; text-align: justify;">&nbsp;</p><ul style="list-style-position: inside;"><li data-list-item-id="ee9f2931df4f6e52aec046ee0870b8337"><p style="margin: 0; text-align: justify;"><strong>Regulate the posting</strong> of a person employed by an employer under the jurisdiction of a foreign country to work temporarily in Lithuania, including applicable working conditions, payment of remuneration, calculation of the posting period, extension with a motivated notification, subcontracting, and other relevant rules stemming from the Posting of Workers Directive and amendments.&nbsp;</p></li><li data-list-item-id="e539bb543b730d58083528ea56401f925"><p style="margin: 0; text-align: justify;">If an employee is posted to Lithuania by an employer of a country that is not a member of the EU or the European Free Trade Association (EFTA), the employee must obtain a permit (Article 108(9) of the Labour Code).</p></li><li data-list-item-id="e8885bc3b01f71439a66017d446b6dbb9"><p style="margin: 0; text-align: justify;">An employer under the jurisdiction of a foreign country who posts a worker to work temporarily in Lithuania for a period exceeding 30 days, or to perform construction work, must &nbsp;give advance notice to the SLI on the <a href="https://vdi.lrv.lt/en/posting-of-workers/?lang=en" target="_blank" rel="noopener noreferrer">notification portal</a> no later than by the commencement of the work of the employee concerned.</p></li><li data-list-item-id="e0614d80bd12b9974e19345dfddbec284"><p style="margin: 0; text-align: justify;">Article 101 of the <strong>Code of Administrative Offences of the Republic of Lithuania</strong> establishes liability for violations of the working conditions of posted workers, as well as liability for the failure to submit a notification on foreigners temporarily posted to work in Lithuania.&nbsp;</p></li></ul><p style="margin: 0; text-align: justify;"><br>The <a href="https://www.e-tar.lt/portal/lt/legalAct/422c8b5042b811e6a8ae9e1795984391/asr" target="_blank" rel="noopener noreferrer">Law on Employment</a> foresees liability for violations of illegal and undeclared work (Articles 56, 56, 58), as well as liability for violations of the procedure for employing foreigners and related notifications on foreigners employed or posted to temporarily work in Lithuania (Article 57).</p><hr><p style="margin: 0;"><span style="font-size:9pt;"><sup>1</sup> </span><a href="https://e-seimas.lrs.lt/portal/legalAct/lt/TAD/6eea48d294ea11eea70ce7cabd08f150?positionInSearchResults=0&amp;searchModelUUID=a69332d2-371e-4dbf-bd3a-d7a8c4d8a200" target="_blank" rel="noopener noreferrer"><span style="font-size:9pt;">XII-2603 Republic of Lithuania Law on Approval, Entry into Force and Implementation of the Labour Code</span></a><span style="font-size:9pt;"> (<strong>as last amended on 6 April 2023</strong>).</span></p></div>
