<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">The <a href="https://diariodarepublica.pt/dr/legislacao-consolidada/lei/2009-34546475" target="_blank" rel="noopener noreferrer"><strong>Portuguese Labour Code</strong></a><strong> </strong>(<strong>approved by Law No. 7/2009 of February 12th</strong>) is the primary legal framework governing employment relations in Portugal. It incorporates Directive 96/71/EC (Posting of Workers Directive). Subsequent amendments to the Directive have been implemented through Law No. 29/2017, ensuring equal treatment of posted workers and alignment with domestic labour standards. </p><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;"><strong>The Portuguese Labour Code:</strong></p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: initial;"><li data-list-item-id="e39ab91b287697c422555ada3c3d77c6f"><p style="margin: 0; text-align: justify;"><strong>Regulates employment conditions</strong>, ensuring that wages, work hours, and benefits are aligned with legal standards for all workers, including foreign employees authorised to work in Portugal (Article 4). For posted workers, <a href="https://dre.pt/dre/legislacao-consolidada/lei/2009-34546475-46718575" target="_blank" rel="noopener noreferrer">Article 7</a><sup>1</sup> ensures that they are entitled to the working conditions set out by law and collective labour regulations in respect of job security, maximum working time, minimum rest periods, holidays, minimum wage and payment for overtime work, assignment of workers by a temporary employment agency, occasional assignment of workers, health and safety at work, parental protection, protection related to the work of minors, and equal treatment and non-discrimination.<sup>2</sup> Minimum remuneration is considered to include the subsidies or allowances granted to the worker as a result of the posting that do not constitute reimbursement of expenses incurred, namely travel, accommodation and food (Article 7(2)(a)). </p></li><li data-list-item-id="e12285dc4a68749d8575f5e29bf64b918"><p style="margin: 0; text-align: justify;"><strong>Defines a worker</strong> as someone who undertakes an activity for an employer under its authority, in exchange for remuneration (<a href="https://diariodarepublica.pt/dr/legislacao-consolidada/lei/2009-34546475-46719275" target="_blank" rel="noopener noreferrer">Article 11</a>).</p></li><li data-list-item-id="e70a321f080fadbe59c3f1e1eb6711ec8"><p style="margin: 0; text-align: justify;"><strong>Defines posted workers</strong> as individuals employed by an entity in another state, performing activities in Portugal under specific conditions (<a href="https://diariodarepublica.pt/dr/legislacao-consolidada/lei/2009-34546475-46718475" target="_blank" rel="noopener noreferrer">Article 6</a>).</p></li><li data-list-item-id="e520fdcc53d7e005975ff5b2d2dbdecea"><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers</strong>, covering both EU nationals and TCNs working in Portugal or posted to other EU Member States.<sup>3</sup></p></li><li data-list-item-id="e539396a2c8a1070f7f163a7a57ea8a05"><p style="margin: 0; text-align: justify;">Provides that the employer must notify the ACT, five days in advance, of the identity of the workers, either EU nationals or TCNs, to be posted abroad, the user, the workplace, the expected start and end of the posting (<a href="https://diariodarepublica.pt/dr/legislacao-consolidada/lei/2009-34546475-46718675" target="_blank" rel="noopener noreferrer">Article 8(2)</a>).</p></li></ul><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;">In addition to the Labour Code,<strong> laws and decree laws</strong> provide specific regulations on the posting of workers. These include tailored provisions addressing various aspects of employment and posting arrangements to ensure compliance with both national and EU standards.</p><p style="margin: 0; text-align: justify;"><br><a href="https://diariodarepublica.pt/dr/detalhe/lei/29-2017-107094724" target="_blank" rel="noopener noreferrer">Law No. 29/2017</a> only transposes the Directive 2014/67/EU of the European Parliament and of the Council of 15 May 2014 concerning the posting of workers in the framework of the provision of services, with rules on the protection of the rights of posted workers, administrative cooperation and mutual assistance between EU Member States, and measures to combat fraud in posting. It establishes that:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: initial;"><li data-list-item-id="ecfdc17e9e4d3055e839d1ab56b1a28ec"><p style="margin: 0; text-align: justify;">When posting to Portugal, a posting declaration must be made to ACT before the beginning of the posting, with the following legally required information: identity of the service provider; number and identification of the workers to be posted (either EU national or TCN); identification of the liaison person; estimated duration and estimated dates for the start and end of the posting; address(es) of the workplace; nature of the services justifying the posting.</p></li><li data-list-item-id="e540b38def4830b2a238ad8c5e98118df"><p style="margin: 0; text-align: justify;">The employer is required to appoint a liaison person with ACT and, if applicable, to liaise with the social partners.</p></li><li data-list-item-id="eb855fce3d5e466bfe9034c2e55a99bc4"><p style="margin: 0; text-align: justify;">During the period of the posting, the employer must keep hard copies or electronic copies of the employment contract, payslips and proof of payment, as well as records of working time in an accessible place and clearly identified in the Portuguese territory. These documents, when requested by ACT, are presented in Portuguese or accompanied by a certified translation.</p></li></ul><hr><p style="margin: 3.0pt 0cm; text-align: justify;"><span style="font-size:10pt;"><sup>1</sup> In conjunction with Articles 3.º-A, 3.º-B and 3.º-C of Law no. 29/2017, of May 30 (amended by Decree-Law No. 101-E/2020, of December 7, 2020).</span></p><p style="margin: 3.0pt 0cm; text-align: justify;"><span style="font-size:10pt;"><sup>2</sup> Pursuant to Article 7(2)(b) and (3) of the Labour Code, holidays, minimum wages, and overtime pay are not applicable to the posting of a qualified worker by a company that supplies goods, to carry out the assembly or initial installation fundamental for its operation, if this is included in the supply contract and its duration does not exceed eight days in a period of one year. However, this exception does not cover cases of posting in construction activities to carry out, repair, maintain, alter, or eliminate constructions, namely excavations, landfills, construction, assembly and dismantling of prefabricated elements, arrangement or installation of equipment, transformation, renovation, repair, conservation, or maintenance, namely painting and cleaning, dismantling, demolition, and sanitation.</span></p><p style="margin: 3.0pt 0cm; text-align: justify;"><span style="font-size:10pt;"><sup>3</sup> The posting of workers in Portugal is administered by Law No. 29/2017, amended by Decree-Law No. 101-E/2020, Decree-Law No. 46/2023, transposing Directive 2014/67/EU of the European Parliament and of the Council of 15 May 2014 concerning the posting of workers in the framework of the provision of services and Articles 6 to 8 of the Portuguese Labour Code.</span></p></div>
