<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">In Cyprus, the <strong>Posting of Workers in the Frame of Provision of Services and Related Matters Law</strong> of 2017 (<a href="https://www.cylaw.org/nomoi/arith/2017_1_063.pdf" target="_blank" rel="noopener noreferrer">Law 63(I)/2017</a>), as amended by <a href="https://www.cylaw.org/nomoi/arith/2020_1_158.pdf" target="_blank" rel="noopener noreferrer">Law 158(I)/2020</a> and <a href="https://www.cylaw.org/nomoi/arith/2022_1_158.pdf" target="_blank" rel="noopener noreferrer">Law 158(I)/2022</a>, transposes EU Directives on the Posting of Workers (96/71/EC &nbsp;and 2014/67/EU), thereby establishing rules on the posting of workers and Regulation Κ.Δ.Π. 196/2017 facilitate enforcement and administrative cooperation. The legislative framework is complemented by the <strong>Temporary Employment Agency Law </strong>of 2012 (<a href="https://www.cylaw.org/nomoi/arith/2012_1_174.pdf" target="_blank" rel="noopener noreferrer">Law 174(I)/2012</a>), as amended by <a href="https://www.cylaw.org/nomoi/arith/2021_1_087.pdf" target="_blank" rel="noopener noreferrer">Law 87(I)/2021</a>, which applies to temporary agency posted workers, and Regulation K.Δ.Π, 517/2012 regarding the administrative procedure. &nbsp;</p><p style="margin: 0; text-align: justify;"><br>The <strong>Posting of Workers in the Frame of Provision of Services and Related Matters Law </strong>of 2017 (<a href="https://www.cylaw.org/nomoi/arith/2017_1_063.pdf" target="_blank" rel="noopener noreferrer">Law 63(I)/2017</a>):</p><p style="margin: 0; text-align: justify;">&nbsp;</p><ul style="list-style-position: inside;"><li data-list-item-id="e57058be2d37e84e701de16ca161886e6"><p style="margin: 0; text-align: justify;"><strong>Regulates employment conditions for posted workers</strong>, covering various aspects such as: maximum working periods and minimum rest periods, minimum wage levels, including overtime pay, protection of the health, safety and hygiene of workers at work, protection of women who are pregnant or have recently given birth at work, protection of children and young people at work, non-discrimination at work (Articles 7 and 10).</p></li><li data-list-item-id="ea280425b64f178d047740e3ebc71b8e7"><p style="margin: 0; text-align: justify;"><strong>Defines a worker</strong> as a person that has an employment relationship with an employer, marked by legal subordination and in which the employer defines the terms and conditions of employment.</p></li><li data-list-item-id="e96e8135bb39a7c8ebc547e10c7ebd43b"><p style="margin: 0; text-align: justify;"><strong>Defines a posted worker</strong> as any employee who typically works in another EU Member State and is temporarily posted to Cyprus by their employer to perform work for a limited period (Article 2).</p></li><li data-list-item-id="e94295f5b2e9e17fb01c48afa21b7ef9c"><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers</strong>, including TCNs, regardless of their nationality, as no specific provisions differentiate between EU nationals and TCNs under the framework governing the posting of workers in Cyprus. In cases where TCNs are posted to Cyprus from another EU Member State, they must hold a single permit for employment in the EU, issued by the sending country.</p></li></ul></div>
