<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">The <a href="https://www.slov-lex.sk/ezbierky/pravne-predpisy/SK/ZZ/2001/311/?ucinnost=27.05.2025" target="_blank" rel="noopener noreferrer"><strong>Slovak Labour Code</strong></a> <strong>(Zákonník práce, Act No. 311/2001)</strong>, Articles 5 to 6, regulates the general framework for posting workers to and from Slovakia, including TCNs working in companies established in other EU Member States. </p><p style="margin: 0; text-align: justify;"><br>The <strong>Labour Code</strong>:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="ec91d0eef23d9420594fe23fed263bf49"><p style="margin: 0; text-align: justify;"><strong>Regulates </strong>individual and collective labour relations between employees and employers in relation to the performance of dependent work. It defines the rights and obligations of both parties and determines the rules of their cooperation. It regulates key areas of employment relations, such as the establishment, change and termination of employment, working time and rest periods, wages and average earnings, obstacles to work and health and safety at work. In addition to the employment relationship, it also covers the regulation of agreements on work performed outside the employment relationship, compensation for damages and rules on collective bargaining. </p></li><li data-list-item-id="e5e423faf008fc9b7d0bf5c33a1c0526c"><p style="margin: 0; text-align: justify;"><strong>Defines posted workers</strong> in two categories (Article 5, Section 8): hosted employees (individuals who, for a specified period, perform work in Slovakia in the course of a service provision while normally working in another EU Member State) and domestic employee (individuals who, for a specified period, perform work in another EU Member State as part of a service provision while normally working in Slovakia).</p></li><li data-list-item-id="e762527c01fe6ff63b413f7378ef26eb7"><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers</strong>, covering those posted from outside or inside Slovakia, including TCNs working in companies established in other EU Member States.</p></li></ul><p style="margin: 0; text-align: justify;"><br><a href="https://www.slov-lex.sk/ezbierky/pravne-predpisy/SK/ZZ/2015/351/20220202" target="_blank" rel="noopener noreferrer">Act No. 351/2015 Coll.</a> further regulates cross-border cooperation in the posting of workers.<br>The social security system for the posting of TCNs is governed by <a href="https://www.slov-lex.sk/ezbierky/pravne-predpisy/SK/ZZ/2003/461/?ucinnost=27.05.2025" target="_blank" rel="noopener noreferrer">Act No. 461/2003 Coll.</a> on social insurance and <a href="https://www.slov-lex.sk/ezbierky/pravne-predpisy/SK/ZZ/2004/580/?ucinnost=27.05.2025" target="_blank" rel="noopener noreferrer">Act No. 580/2004 Coll.</a> on health insurance. </p><p style="margin: 0; text-align: justify;"><br><a href="https://www.slov-lex.sk/ezbierky/pravne-predpisy/SK/ZZ/2011/404/20241215" target="_blank" rel="noopener noreferrer">Act No. 404/2011 Coll.</a> on the residence of foreigners regulates the types of residence of foreigners on the territory of the Slovak Republic and their associated conditions.</p><p style="margin: 0; text-align: justify;"><br><a href="https://www.slov-lex.sk/ezbierky/pravne-predpisy/SK/ZZ/2006/124/?ucinnost=27.05.2025" target="_blank" rel="noopener noreferrer">Act No. 124/2006 Coll.</a> on occupational safety and health (OSH) regulates the requirements for the basic conditions of prevention and protection of occupational health to eliminate risks and diseases.</p><p style="margin: 0; text-align: justify;"><br>The specific rules for the cross-border posting of drivers regulated by Directive (EU) 2020/1057 are reflected in the following Slovak legislation: <a href="https://www.slov-lex.sk/ezbierky/pravne-predpisy/SK/ZZ/2007/462/20250201" target="_blank" rel="noopener noreferrer">Act No. 462/2007 Coll</a>. on the organisation of working time in transport, Article 4(a) of Act No. 351/2015, Article 5(a) of the Labour Code, and <a href="https://www.slov-lex.sk/ezbierky/pravne-predpisy/SK/ZZ/2004/5/?ucinnost=27.05.2025" target="_blank" rel="noopener noreferrer">Act No. 5/2004 Employment Services Act</a> – Fifth Part, §21 - §24 – employment of TCNs.</p><p style="margin: 0; text-align: justify;"><br>Labour inspection is a key mechanism for enforcing labour law and protecting workers’ rights. It is governed by <a href="https://www.slov-lex.sk/ezbierky/pravne-predpisy/SK/ZZ/2006/125/20250401" target="_blank" rel="noopener noreferrer">Act No. 125/2006 Coll.</a> on labour inspection and is overseen by the Ministry of Labour, Social Affairs and Family. </p><p style="margin: 0; text-align: justify;"><br>The NIP, based in Košice, is the central authority, with nationwide competence. It coordinates, supervises, and standardises the work of the regional inspectorates. It also manages strategic programmes, training, and international cooperation, and ensures that inspections are carried out consistently across the country.</p><p style="margin: 0; text-align: justify;"><br>The regional labour inspectorates are responsible for carrying out inspections at local level. They monitor compliance with labour law provisions, including employment contracts, working conditions, wages, OSH, and the prohibition of illegal work and employment. They also oversee the working conditions of vulnerable groups such as women, adolescents, persons with disabilities, and minors.</p><p style="margin: 0; text-align: justify;"><br>In practice, labour inspectors can visit workplaces (either announced or unannounced) to check documentation, interview employees, and assess working conditions. If they find violations, they can impose fines, order corrective measures, or refer cases for further legal action.</p><p style="margin: 0; text-align: justify;"><br>In the context of posting of workers, including TCNs, host employers in Slovakia are required to notify the NIP electronically about the posting, no later than on the day the posting begins. This includes providing detailed information about the posted worker, the employer, and the nature of the work.</p></div>
