This model is supported by a framework of national legislation that sets minimum standards while allowing for flexibility through<strong> collective agreements</strong> (kollektivavtal). Collective bargaining agreements play an important role in establishing specific working conditions tailored to different industries. Case law also plays a crucial role in the Swedish labour law model. The most important laws include: the Employment Protection Act (1982:80), which regulates employment contracts, dismissals, and job security; the Co-Determination in the Workplace Act (1976:580), which governs the rights of employees to participate in decision-making through their unions; the Working Hours Act (1982:673), which sets rules on working time, rest, and overtime; the Work Environment Act (1977:1160), which ensures a safe and healthy workplace; and the Discrimination Act (2008:567), which prohibits discrimination and promotes equal rights and opportunities in working life. Together, these laws provide the statutory backbone of Swedish labour relations, complementing the collective agreements negotiated by the labour market parties.</span></p><p style="margin: 0; text-align: justify;"><br><span style="font-size:11pt;">The Posting of Workers Act (Lag om utstationering av arbetstagare, 1999:678) transposes the EU directives on the posting of workers into Swedish law. </span></p><p style="margin: 0; text-align: justify;"><br><span style="font-size:11pt;"><strong>Posting of Workers Act (1999:678): </strong></span></p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li class="ck-list-marker-font-size" style="--ck-content-list-marker-font-size:11pt;" data-list-item-id="e15e10b6faa86211e27f179ce91babdb2"><p style="margin: 0; text-align: justify;"><span style="font-size:11pt;"><strong>Defines the Swedish laws applied within the area of posting and regulates employment conditions</strong>, covering various aspects such as: working time <strong>(Working Hours Act 1982:673)</strong>, minimum paid annual leave <strong>(Annual Leave Act 1977:480)</strong>, parental leave rights<strong> (Parental Leave Act 1995:584)</strong>, health, safety, and hygiene at work <strong>(Work Environment Act 1977:1160)</strong>, anti-discrimination provisions <strong>(Anti-Discrimination Act 2008:567)</strong>, protection for temporary agency workers <strong>(Temporary Workers Act 2012:854)</strong>, freedom of association and collective bargaining rights <strong>(Co-Determination Act 1976:580)</strong>, anti-discrimination provisions against part-time and fixed-term employees concerning wages and other employment conditions (<strong>Prohibition of Discrimination of Employees Working Part Time and Employees with Fixed-term Employment Act (2002:293</strong>)), and the liability of contractors for unpaid wages owed to workers in the construction sector (<strong>Act (2018:1472) on Contractor Liability for Wage Claims</strong>). It also refers to the <strong>Working Hours for Certain Road Transport Work Act (2005:395</strong>), which regulates working hours, rest periods, and driving times for road transport workers; the <strong>Working Hours, etc. of Mobile Workers in Civil Aviation Act (2005:426</strong>), which sets rules on working and rest periods specifically for mobile workers in civil aviation; the <strong>Driving and Rest Periods for International Railway Transport Act (2008:475)</strong>, which regulates driving and rest times for workers involved in international railway transport, and the <strong>Private Employment Agencies and Temporary Labour Act (1993:440)</strong>, which governs the operation of private employment agencies and protects temporary agency workers.</span></p></li></ul><p style="margin: 0; text-align: justify;"><span style="font-size:11pt;"><strong>- Ensures the application</strong> of Swedish labour law in its entirety for postings exceeding 12 months, except for rules on contract initiation and termination (Section 11 of the Posting of Workers Act 1999:678).</span></p><p style="margin: 0; text-align: justify;"><span style="font-size:11pt;"><strong>- Defines posted worker </strong>as any worker who normally works in another country, but who performs work in Sweden for a limited period of time (Section 5 of the Posting of Workers Act 1999:678). While there is a definition of worker in Sweden, the term is not strictly defined in legislation, but, rather, has evolved through case law, with an overall assessment made in each case.</span></p><p style="margin: 0; text-align: justify;"><span style="font-size:11pt;"><strong>- Applies to all posted workers</strong>, including TCNs, ensuring that they receive core working conditions.</span></p></div>
