<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">The <a href="https://postedworkers.gli.government.bg/en/15/kodeksi/?p=12_kodeks-na-truda" target="_blank" rel="noopener noreferrer"><strong>Labour Code</strong></a> (Article 121a) transposes Directive 96/71/EC (Posting of Workers Directive) and Directive 2018/957/EU (Enforcement Directive), ensuring equal treatment for posted workers in Bulgaria and establishing minimum working conditions. The<a href="https://postedworkers.gli.government.bg/en/13/naredbi-vav-vrazka-s-usloviyata-na-trud-i-trudovata-mobilnost-v-r-balgariya/?p=66_naredba-za-usloviyata-i-reda-za-komandirovane-i-izpra%D1%89ane-na-rabotnitsi-i-slugiteli-v-ramkite-na-predostavyane-na-uslugi" target="_blank" rel="noopener noreferrer"> <strong>Ordinance on the Terms and the Procedure for Posting and Sending of Workers and Employees in the Framework of the Provision of Services</strong></a> and the <a href="https://postedworkers.gli.government.bg/en/65/zakon-za-trudovata-migratsiya-i-trudovata-mobilnost----dopalnitelni-razporedbi/" target="_blank" rel="noopener noreferrer"><strong>Amendments to the Ordinance</strong></a> complement the legal framework on posting.&nbsp;</p><p style="margin: 0; text-align: justify;">&nbsp;</p><p style="margin: 0; text-align: justify;"><strong>The Labour Code:</strong></p><p style="margin: 0; text-align: justify;">&nbsp;</p><ul style="list-style-position: initial;"><li data-list-item-id="e2457d37001232a2d327088a271a0831d"><p style="margin: 0; text-align: justify;">Applies to labour relationships between an employee and an employer (Article 1(1) and (2)).</p></li><li data-list-item-id="ed1ce14e723381097a051319b07446ea0"><p style="margin: 0; text-align: justify;"><strong>Regulates employment conditions</strong>, covering various aspects such as: working time, bank holidays, annual paid vacation days, minimum wage and salary payment rules (the basic amount of the work salary and additional labour remunerations, the conditions for laying additional and night labour and the amount of its payment), special protection of minors and person with reduced capacity for work, maternity protection, workplace health and safety conditions, the conditions for housing when it is provided by the employer or the enterprise that provides temporary work, travel, subsistence and accommodation allowances, and the right to strike.</p></li><li data-list-item-id="e3d5bc2b90c7d8fb905c176e91879542e"><p style="margin: 0; text-align: justify;"><strong>Guarantees for posted workers </strong>of the same minimum working conditions as local employees performing similar work. If the posting exceeds 12 months, the worker is entitled to additional employment conditions under Bulgarian law (Article 121a(4)).</p></li><li data-list-item-id="ec9d051ec32e038f19f19cef626d31e4e"><p style="margin: 0; text-align: justify;">There is <strong>no definition of ‘worker’</strong> in national legislation. A worker is a natural person who temporarily provides their labour to an employer in exchange for remuneration.</p></li></ul><p style="margin: 0; text-align: justify;">&nbsp;</p><p style="margin: 0; text-align: justify;"><strong>The </strong><a href="https://www.mlsp.government.bg/uploads/19/zaetost/labour-migration-and-labour-mobility-act.pdf" target="_blank" rel="noopener noreferrer"><strong>Labour Migration and Labour Mobility Act</strong></a><strong> (LMLMA):</strong></p><p style="margin: 0; text-align: justify;">&nbsp;</p><ul style="list-style-position: initial;"><li data-list-item-id="ea07671e5ea79182975a0fcbb1aab1d06"><p style="margin: 0; text-align: justify;"><strong>Defines a ‘posted’ or ‘sent’ worker</strong> as a worker, national of an EU Member State, or a TCN who, for a specified period, carries out work in Bulgaria under an employment contract with an employer established in another EU Member State or a third country.</p></li></ul><p style="margin: 0; text-align: justify;">&nbsp;</p><p style="margin: 0; text-align: justify;">Bulgarian labour legislation <strong>applies to all posted workers</strong>, including TCNs, when posted to Bulgaria (Article 121a(5) of the Labour Code).</p></div>
