It incorporates the EU Posting of Workers Directives (96/71/EC and 2018/957/EU), ensuring equal treatment for posted workers, including TCNs. </p><p style="margin: 0; text-align: justify;"><br>The <strong>Czech Labour Code:</strong></p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="e67c360c29ab98e26e86f01de08f3791c"><p style="margin: 0; text-align: justify;"><strong>Regulates employment conditions</strong>, including working conditions and remuneration of posted workers. For postings from other EU Member States, Sections 319 and 319a ensure that posted workers benefit from Czech labour standards where more advantageous, covering: maximum working hours and minimum rest periods, minimum leave entitlements, minimum wage and mandatory wage components (overtime pay, holiday pay, allowances for night work, weekend work, etc.), workplace health and safety, equal treatment and non-discrimination, special protections for pregnant workers, new mothers, and young workers, conditions for agency work and employer-provided accommodation, reimbursement of work-related travel expenses. </p></li><li data-list-item-id="ed58103a6dfdcd006f49fdd3bdb3a1364"><p style="margin: 0; text-align: justify;"><strong>Exemptions</strong> apply for short-term postings (up to 30 days per calendar year), excluding minimum wage, guaranteed wage levels, and leave entitlements. For long-term postings exceeding 12 months (extendable to 18 months with notification to the State Labour Inspection Office made through the online registration portal), additional Labour Code provisions apply, except for rules on employment termination.</p></li><li data-list-item-id="ebe5ca472c5845a7ed7b68cacf08adef9"><p style="margin: 0; text-align: justify;">The Labour Code<strong> does not use the term “worker” but rather “employee.” </strong>According to Section 6 of the Labour Code, an employee is a natural person who has committed to performing dependent work within a fundamental employment relationship.</p></li><li data-list-item-id="eb874568cddd0f9fc037fbff0c48cbbf0"><p style="margin: 0; text-align: justify;">The Labour Code and related regulation <strong>do not provide an explicit definition of a “posted worker.”</strong> Instead, a description of the situation is used; for example, the Labour Code refers to an “employee of an employer from another EU member state posted to perform work as part of the cross-border provision of services.” Section 319 of the Labour Code ensures that posted workers are entitled to key labour conditions such as minimum wage, working hours, and health and safety protections.</p></li><li data-list-item-id="e38de0e08c23403377b4284c662d6ad6d"><p style="margin: 0; text-align: justify;">The <a href="https://www.e-sbirka.cz/sb/2004/435/2025-06-01?f=435%2F2004&zalozka=text" target="_blank" rel="noopener noreferrer"><strong>Act No. 435/2004 </strong></a><strong>Coll. on Employment </strong>(Act on Employment) further regulates the conditions under which foreign workers, including posted workers, can work in Czechia. It establishes employer obligations when posting workers to Czechia, including a notification obligation (Section 101a). This obligation relates to employers from other Member States who post their employees to Czechia. Section 95 (1) of the Act on Employment regulates posting of workers by third country employers where an employment permit is required. In this context, the Act on Employment also provides for a requirement to have a Czech-translated copy of the labour contract at the workplace (Section 136(2)).</p></li></ul><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;">The <a href="https://www.e-sbirka.cz/sb/1999/326/2025-02-11?f=326%2F1999&zalozka=text" target="_blank" rel="noopener noreferrer"><strong>Residence of Foreign Nationals Act</strong></a> (Act No. 326/1999 Coll.) governs residence permits, including the non-dual mode employee card (Section 42g) and short-stay visa (Section 17b), relevant for posted TCNs.</p><p style="margin: 0; text-align: justify;"><br>Other key legislation includes:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="eac4115cbe647bafaa1fca247c5463179"><p style="margin: 0; text-align: justify;"><a href="https://www.e-sbirka.cz/sb/2006/187?zalozka=text" target="_blank" rel="noopener noreferrer">Sickness Insurance Act</a> (Act No. 187/2006 Coll.), aligning social security rules with EU regulations.</p></li><li data-list-item-id="e2461d299eb9d3dbad29e8badace99e29"><p style="margin: 0; text-align: justify;"><a href="https://www.e-sbirka.cz/sb/1997/48?zalozka=text" target="_blank" rel="noopener noreferrer">Health Insurance Act</a> (Act No. 48/1997 Coll.), defining health insurance access and obligations.</p></li><li data-list-item-id="eb66e7ae132fbc9919232ff43c4d6d8f4"><p style="margin: 0; text-align: justify;"><a href="https://www.e-sbirka.cz/sb/2005/251?zalozka=text" target="_blank" rel="noopener noreferrer">Labour Inspection Act</a> (Act No. 251/2005 Coll.) and Inspection Code (Act No. 255/2012 Coll.), regulating labour inspections.</p></li></ul></div>
