<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">Finnish labour law is primarily governed by the <a href="https://www.finlex.fi/en/legislation/2001/55?language=fin&highlightId=987950&highlightParams=%7B%22type%22%3A%22BASIC%22%2C%22search%22%3A%2255+2001%22%7D" target="_blank" rel="noopener noreferrer">Employment Contracts Act (Työsopimuslaki, 55/2001)</a> and other specific regulations, including the <a href="https://www.finlex.fi/en/legislation/2016/447?language=fin" target="_blank" rel="noopener noreferrer">Posted Workers Act (447/2016)</a>. The latter transposes the Posting of Workers Directive and its amendments and determines the minimum employment conditions applicable to posted workers under Finnish labour law. Collective agreements, prevalent in Finland, also apply to posted TCNs.</p><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;"><strong>Finnish labour law</strong>: </p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="e7007070fe0b208dacba54074b76290bb"><p style="margin: 0; text-align: justify;"><strong>Defines minimum working conditions for posted workers</strong>, including: working hours and rest periods (<a href="https://www.finlex.fi/en/legislation/2019/872?language=fin" target="_blank" rel="noopener noreferrer">Working Time Act, 872/2019</a>), minimum paid annual leave (<a href="https://www.finlex.fi/en/legislation/2005/162?language=fin" target="_blank" rel="noopener noreferrer">Annual Holidays Act, 162/2005</a>), remuneration, including overtime pay, health, safety, and hygiene at work (<a href="https://www.finlex.fi/en/legislation/2002/738?language=swe" target="_blank" rel="noopener noreferrer">Occupational Safety and Health Act, 738/2002</a>), <a href="https://www.finlex.fi/en/legislation/2001/1383?language=fin" target="_blank" rel="noopener noreferrer">Occupational Health Care Act, 1383/2001</a> and <a href="https://www.finlex.fi/en/legislation/2002/738?language=swe&highlightId=988115&highlightParams=%7B%22type%22%3A%22BASIC%22%2C%22search%22%3A%22738%2F2002%22%7D" target="_blank" rel="noopener noreferrer">Occupational Safety and Health Act, 738/2002</a>, protection for young workers (<a href="https://www.finlex.fi/en/legislation/1993/998?language=fin" target="_blank" rel="noopener noreferrer">Young Workers Act, 998/1993</a>), equality of treatment between women and men (<a href="https://www.finlex.fi/en/legislation/1986/609?language=swe" target="_blank" rel="noopener noreferrer">Act on Equality between Women and Men, 609/1986</a>) and non-discrimination provisions (<a href="https://www.finlex.fi/en/legislation/2014/1325?language=fin" target="_blank" rel="noopener noreferrer">Non-Discrimination Act, 1325/2014</a>).</p></li><li data-list-item-id="e3f1567563b149c469e99d73d0b328d7f"><p style="margin: 0; text-align: justify;"><strong>For long-term postings</strong> (12 months or more), posted workers are entitled to additional employment conditions under applicable collective agreements, with exceptions for contract termination, non-competition obligations, and supplementary occupational pensions.<sup>1 </sup></p></li><li data-list-item-id="eee9e9f04b693f658935f6084a2fa8666"><p style="margin: 0; text-align: justify;"><strong>Defines a worker </strong>as someone who personally agrees to perform work for an employer under the employer's direction and supervision in return for pay or some other remuneration (<a href="https://www.finlex.fi/en/legislation/2001/55?language=fin&highlightId=987950&highlightParams=%7B%22type%22%3A%22BASIC%22%2C%22search%22%3A%2255+2001%22%7D" target="_blank" rel="noopener noreferrer">Chapter 1, Section 1, of the Employment Contracts Act</a>).</p></li><li data-list-item-id="e582b97fcf19ae74616cc8a8a12b05e9d"><p style="margin: 0; text-align: justify;">Defines <strong>a posted worker </strong>as a worker who normally carries out their work in a state other than Finland and whom an employer undertaking that is established and performing activities in another state posts to Finland for a limited period to perform temporary work in the course of a contractual employment relationship within the framework of providing cross-border services as subcontracted work, as an internal transfer within a group of undertakings or as temporary agency work (<a href="https://www.finlex.fi/en/legislation/2016/447?language=fin" target="_blank" rel="noopener noreferrer">Chapter 1, Section 2, of the Posted Workers Act</a>). </p></li><li data-list-item-id="e7e4906c5a1507f53bcf7a48350f94521"><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers</strong>, including TCNs legally residing in Finland. While posted workers usually remain under their home country’s social security system, Finnish law sets the minimum employment standards that must be respected. </p></li></ul><p style="margin: 0; text-align: justify;"><br>In addition to labour law, universally binding <strong>collective bargaining agreements</strong> are generally applicable to posted TCNs, further defining the working conditions and minimum salaries to be paid, for example. The coverage of collective bargaining agreements in Finland is high.<sup>2 </sup></p><p style="margin: 0; text-align: justify;"><br>The OSH Administration has extensive information and guidance in English on <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker" target="_blank" rel="noopener noreferrer">posted workers</a>, including on questions pertaining to <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/applicable-legislation" target="_blank" rel="noopener noreferrer">applicable labour legislation</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/reporting-duty" target="_blank" rel="noopener noreferrer">notification duty</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/employers-representative" target="_blank" rel="noopener noreferrer">employer’s representative</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/keeping-the-information-available" target="_blank" rel="noopener noreferrer">duty to keep information available</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/right-to-work" target="_blank" rel="noopener noreferrer">right to work</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/internal-transfer-in-international-company" target="_blank" rel="noopener noreferrer">ICTs</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/pay-and-compensation-in-finland" target="_blank" rel="noopener noreferrer">pay in Finland</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/working-hours" target="_blank" rel="noopener noreferrer">working hours</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/accident-insurance" target="_blank" rel="noopener noreferrer">accident insurance</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/occupational-health-care" target="_blank" rel="noopener noreferrer">occupational health care</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/accommodation-conditions" target="_blank" rel="noopener noreferrer">accommodation conditions</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/taxes" target="_blank" rel="noopener noreferrer">taxes and tax numbers</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/posting-in-road-transport" target="_blank" rel="noopener noreferrer">posting in road transport</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/long-term-posting" target="_blank" rel="noopener noreferrer">long-term posting</a>, <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/contractor-s-obligations-in-posting" target="_blank" rel="noopener noreferrer">contractor’s obligations in postings</a> and <a href="https://tyosuojelu.fi/en/employment-relationship/posted-worker/penalty-fee-for-negligence" target="_blank" rel="noopener noreferrer">negligence fee</a>.
