<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">Hungarian labour law is primarily governed by <strong>Act I of 2012 on the </strong><a href="https://njt.hu/jogszabaly/2012-1-00-00" target="_blank" rel="noopener noreferrer"><strong>Labour Code</strong></a> (2012. évi I. törvény a Munka törvénykönyvéről), which regulates employment relations, including for posted workers (Articles 295–297). It transposes the Posting of Workers Directive and its amendments. These provisions apply to all posted workers, including TCNs employed by companies established in other EU Member States.</p><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;"><strong>The Hungarian Labour Code:</strong></p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: initial;"><li data-list-item-id="e3b724cb6a6eb64be5ff262bf7e7dbda4"><p style="margin: 0; text-align: justify;"><strong>Regulates employment conditions</strong>, covering various aspects such as maximum working time and minimum rest periods, minimum annual paid leave, remuneration (including overtime pay), conditions for temporary agency work, occupational safety and health (OSH), protective measures for pregnant workers and young workers, equality of treatment between men and women, employer-provided accommodation conditions, and allowances or reimbursement of travel, board, and lodging expenses.</p></li><li data-list-item-id="e1a69ca33aa90704141c2684e5314693b"><p style="margin: 0; text-align: justify;"><strong>For long-term postings</strong> (12 months or 18 months in the case of notification submitted by the foreign employer to the employment supervisory authority), posted workers are entitled to additional employment conditions and the provisions of the Labour Code shall apply to them.</p></li><li data-list-item-id="e57279d543dc493f394956d2abc42b601"><p style="margin: 0; text-align: justify;">The <strong>definition of workers</strong> in the Labour Code is an inclusive definition that covers all private individuals who perform work under an employment contract (Article 34(1)). This definition emphasises that the work to be carried out should be based on an employment relationship. Although Hungarian law does not explicitly define employment relationships, they are understood as contracts where the worker follows the employer’s instructions. By contrast, other types of work relationships, such as service contracts or agency agreements, are regulated by Act V of 2013 on the <a href="https://njt.hu/jogszabaly/2013-5-00-00" target="_blank" rel="noopener noreferrer">Civil Code</a> (2013. évi V. törvény a Polgári Törvénykönyvről). These are different because the person performing the work has more autonomy and is not under the direct control of the other party, unlike in employment relationships where the worker has limited independence.</p></li><li data-list-item-id="e2366464138f9c01f8e154f6efadc5f85"><p style="margin: 0; text-align: justify;">The <strong>definition of posted workers</strong> in the Labour Code is when a foreign employer employs an employee in the territory of Hungary - under an agreement with a third party for the provision of services – in an employment relationship that is not covered by Hungarian law (Article 295(1)).</p></li><li data-list-item-id="e7cde880e91f469d1a6b0edc5ad5e0b9f"><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers</strong> posted from outside Hungary, including TCNs working in companies established in other EU Member States.</p></li></ul></div>
