All other employment regulations build on these primary sources.</p><p style="margin: 0; text-align: justify;"><br>The <strong>Civil Code</strong>:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="e23d2015dbf0a18bcc911cdf3007309e1"><p style="margin: 0; text-align: justify;"><strong>Regulates employment conditions</strong>, ensuring that employers’ powers of organisation, control, and discipline are exercised in compliance with the law, and that employees receive their entitlements in relation to their work-relationship (e.g., wages, working time, rest periods, holidays, permits, severance pay, indemnities, etc.). The Civil Code provides for a basic infrastructure applicable to all employees who perform their job in Italy, with specific disciplines (based on the sector of activity) dictated by collective agreements and special laws.</p></li><li data-list-item-id="e9535f4af753c20819e3858296e24505b"><p style="margin: 0; text-align: justify;"><strong>Defines a worker (employee)</strong> as a person who, in exchange for remuneration, commits to cooperate in the enterprise, performing intellectual or manual work at the employer’s premises and under the employer’s direction (<a href="https://www.gazzettaufficiale.it/atto/serie_generale/caricaArticolo?art.versione=2&art.idGruppo=263&art.flagTipoArticolo=2&art.codiceRedazionale=042U0262&art.idArticolo=2094&art.idSottoArticolo=1&art.idSottoArticolo1=10&art.dataPubblicazioneGazzetta=1942-04-04&art.progressivo=0#:~:text=2094)-,Art.,sotto%20la%20direzione%20dell'imprenditore." target="_blank" rel="noopener noreferrer">Article 2094</a>, Civil Code).</p></li></ul><p style="margin: 0; text-align: justify;"><br>The <strong>Italian Constitution</strong>:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="ef50be1da13029b8a84081f9431102d8a"><p style="margin: 0; text-align: justify;"><strong>Guarantees workers the right to fair remuneration</strong>, proportionate to the quantity and quality of work performed, ensuring a dignified standard of living (<a href="https://www.gazzettaufficiale.it/atto/serie_generale/caricaArticolo?art.versione=2&art.idGruppo=263&art.flagTipoArticolo=2&art.codiceRedazionale=042U0262&art.idArticolo=2094&art.idSottoArticolo=1&art.idSottoArticolo1=10&art.dataPubblicazioneGazzetta=1942-04-04&art.progressivo=0#:~:text=2094)-,Art.,sotto%20la%20direzione%20dell'imprenditore." target="_blank" rel="noopener noreferrer">Article 36</a><sup>1</sup>, Constitution). Italy does not set a statutory minimum wage by law. Rather, minimum wage levels are established through collective labour agreements negotiated by the most representative national trade unions (e.g. Article 39, Constitution), covering all sectors of production. When assessing wage adequacy, employers must refer to the wage standards of the country where the worker is posted.</p></li></ul><p style="margin: 0; text-align: justify;"><br><a href="https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2016-07-17;136" target="_blank" rel="noopener noreferrer"><strong>Legislative Decree No. 136/2016</strong></a>:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="e4e433d7ee56aa5fcff8a19bed6040012"><p style="margin: 0; text-align: justify;"><strong>Defines posted workers</strong> as individuals employed by a company in another state who carry out activities in Italy for a limited period, predetermined or linked to a specific future event. This definition includes workers employed by a temporary work agency (TWA) established in an EU Member State who are posted to a subsidiary in Italy (Article 2 (d)).</p></li></ul><p style="margin: 0; text-align: justify;"><br><a href="https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2020-09-15;122" target="_blank" rel="noopener noreferrer"><strong>Legislative Decree No. 122/2020</strong></a><strong>:</strong></p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="edde16287d98c58dba0de84aac74849e9"><p style="margin: 0; text-align: justify;"><strong>Ensures that posted workers receive the same working and employment</strong> conditions as workers performing similar tasks in Italy, as required by law and collective labour agreements, if more favourable. Key areas where equal treatment must be guaranteed include: working time and rest periods, minimum annual paid leave (<a href="https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2003-04-08;66" target="_blank" rel="noopener noreferrer">Legislative Decree No. 66/2003</a>), wages, including overtime, (<a href="https://www.senato.it/sites/default/files/repository/Costituzione_INGLESE_2023.pdf" target="_blank" rel="noopener noreferrer">Article 36 of the Italian Constitution</a> and relevant collective agreements), conditions for temporary agency work (<a href="https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2015-06-15;81" target="_blank" rel="noopener noreferrer">Article 35 of Legislative Decree No. 81/2015</a>, on equal treatment), health and safety at work (<a href="https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2008-04-09;81" target="_blank" rel="noopener noreferrer">Legislative Decree No. 81/2008</a>), protection for pregnant workers, parenthood, children and young workers (<a href="https://www.gazzettaufficiale.it/eli/id/2001/04/26/001G0200/sg" target="_blank" rel="noopener noreferrer">Legislative Decree No. 151/2001</a>), equal treatment and non-discrimination (<a href="https://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto.legislativo:2006-04-11;198" target="_blank" rel="noopener noreferrer">Legislative Decree No. 198/2006</a>), accommodation conditions when provided by the employer (as per collective agreements), and travel, board and lodging allowances for work-related travel (as per applicable collective agreement).</p></li><li data-list-item-id="e1563c30147019454e5f43c138fecfdf1"><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers</strong>, including both EU and TCN workers.</p></li></ul><hr><p style="margin: 0; text-align: justify;"><span style="font-size:9pt;"><sup>1 </sup>Article 36: ‘Workers shall be entitled to a remuneration commensurate to the quantity and quality of their work and in any case such as to ensure them and their families a free and dignified existence. The maximum daily working hours shall be established by law. Workers shall have the right to a weekly rest day and paid yearly holidays. They may not waive this right.’</span></p></div>
