Directive 96/71/EC (Posting of Workers Directive) was transposed into national law by the <strong>Law of 20 December 2002</strong>, adding specific rules on posting to the Labour Code. These rules were later updated by the <strong>Law of 15 December 2020</strong>, following Directive (EU) 2018/957. This general framework applies to all workers posted from outside Luxembourg, including TCNs working in companies established in other EU Member States. </p><p style="margin: 0; text-align: justify;"><br>The <strong>Labour Code</strong>:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="e71cc7655ee25ce132b4f7188bb351c34"><p style="margin: 0; text-align: justify;"><strong>Establishes the legal framework governing the posting of workers</strong> to Luxembourg in the context of cross-border service provision (Articles L.141-1 to L.144-10).</p></li><li data-list-item-id="e1806fbc28b1fe524985dd091bb5680d8"><p style="margin: 0; text-align: justify;"><strong>Defines a posted worker</strong> as someone who usually works abroad but temporarily carries out their activity in Luxembourg under a service contract (Article 141-1 (3)).</p></li><li data-list-item-id="e050ccc4db365daed1a3d91405edf5503"><p style="margin: 0; text-align: justify;"><strong>Ensures posted workers benefit from a set of core employment conditions</strong> equivalent to those applicable to workers locally employed in Luxembourg, including minimum standards in areas such as remuneration (including minimum wage and indexation), maximum work periods and minimum rest periods, paid annual leave and public holidays, health and safety at work, and conditions applicable to temporary agency work and fixed-term or part-time contracts. It also includes rules on equal treatment and non-discrimination, accommodation standards when provided by the employer, and the reimbursement of costs related to travel, board, and lodging</p></li><li data-list-item-id="e0743d3df17008a198252c16619d8004e"><p style="margin: 0; text-align: justify;"><strong>Regulates the exercise of fundamental rights</strong> of posted workers, including the freedom to strike and engage in collective bargaining, the right to undertake collective action, and the right to negotiate, to conclude and enforce collective agreements, or to take collective action, and ensures that these rights are not limited by their posted status (Article L.141-1 (1)).</p></li><li data-list-item-id="e7ffac9544b0ac2e09e587bf15d86b1ee"><p style="margin: 0; text-align: justify;"><strong>Defines an ‘employment contract’</strong> as an agreement under which a natural person (excluding public employees) works for an employer under a relationship of subordination in return for remuneration (Article L.127-2); this definition extends to trainees, apprentices, and students working during school holidays (Article L. 611-2).</p><p style="margin: 0; text-align: justify;"> </p></li><li data-list-item-id="e035af593834babb027d5d68a68f2b09c"><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers</strong>, covering workers posted from outside Luxembourg, including TCNs working in companies established in other EU Member States. </p></li></ul></div>
