The <a href="https://isap.sejm.gov.pl/isap.nsf/download.xsp/WDU20160000868/T/D20160868L.pdf" target="_blank" rel="noopener noreferrer"><strong>Act of 10 June 2016 on the posting of workers in the framework of the provision of services</strong></a>, the <a href="https://cudzoziemiecwpolsce.pl/wp-content/uploads/2014/10/ACT-of-12-December-2013-on-foreigners-in-English.pdf" target="_blank" rel="noopener noreferrer"><strong>Act of 12 December 2013 on foreigners</strong></a>, and the <a href="https://eli.gov.pl/api/acts/DU/2025/621/text/T/D20250621L.pdf" target="_blank" rel="noopener noreferrer"><strong>Act of 20 March 2025 on the conditions for the admissibility of entrusting work to foreigners on the territory of the Republic of Poland</strong></a> comprise the main Polish legislation governing posting of workers and access to the Polish labour market.</p><p style="margin: 0; text-align: justify;"><br>The Act of 10 June 2016 transposes Directive 96/71/EC, Directive 2014/67/EU (on enforcement), and Directive 2018/957/EU (on amendments to the Posting of Workers Directive).</p><p style="margin: 0; text-align: justify;"><br>For TCNs posted from other EU/EEA States, the same legal provisions apply. However, under the Act of 12 December 2013 on foreigners, posted workers cannot apply for a temporary work and residence permit (single permit) and blue EU Card permit, and the period of posting does not count toward the five-year residency requirement for long-term EU residence.</p><p style="margin: 0; text-align: justify;"><br>The <a href="https://www.gov.pl/web/family/basic-information-on-labour-law" target="_blank" rel="noopener noreferrer"><strong>Labour Code</strong></a>:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="e658ad16895a3eff3f4ab76db40397878"><p style="margin: 0; text-align: justify;"><strong>Regulates working conditions</strong>, covering various aspects such as: maximum working time and daily and weekly rest periods, duration of annual leave, remuneration, occupational health and safety, protection for pregnant workers and during maternity leave, protection for young workers and specially employment of adolescents, equal treatment and non-discrimination, reimbursement of business travel expenses.</p></li><li data-list-item-id="ee9c6c276b474887890b219a82ea0cb14"><p style="margin: 0; text-align: justify;">Contains a <strong>definition </strong>of an employee (as a person employed on the basis of an employment contract, an appointment, an election, a nomination or a co-operative employment contract; article 2), employer (as an organisational unit, even if it has no legal personality, or an individual, provided it employs employees; article 3), and employment relationship (as a situation in which an employee undertakes to perform work of a specified type for the benefit of an employer and under his supervision, in a place and at the times specified by the employer; the employer undertakes to employ the employee in return for remuneration; article 22). These definitions determine who qualifies for employment protections and rights under national law.</p></li></ul><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;">The <a href="https://isap.sejm.gov.pl/isap.nsf/download.xsp/WDU20022001679/U/D20021679Lj.pdf" target="_blank" rel="noopener noreferrer"><strong>Act of 10 October 2002 on the minimum remuneration for work</strong></a>:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="e05a37e37ba8d878cdd8cd65201d02d81"><p style="margin: 0; text-align: justify;">Regulates how <strong>minimum wage </strong>and <strong>hourly minimum rate</strong> is established and applied, as well as stipulates the exemptions.</p></li><li data-list-item-id="e499c6ffaef6bc0b52f9f661fb8b50b97"><p style="margin: 0; text-align: justify;">the precise amount of minimum wage and hourly minimum rate is regulated by the announcement of the president of the Council of Ministers or the regulation of the Council of Ministers, depending on whether tripartite Council of Social Dialogue reaches an agreement on the amount of minimum wage and hourly minimum rate in a given year.</p></li></ul><p style="margin: 0; text-align: justify;"><br>The <a href="https://isap.sejm.gov.pl/isap.nsf/download.xsp/WDU20160000868/T/D20160868L.pdf" target="_blank" rel="noopener noreferrer"><strong>Act of 10 June 2016 on the posting of workers in the framework of the provision of services</strong></a>:</p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="ecdcf9bcaaaeca4089834ed864c887e81"><p style="margin: 0; text-align: justify;">Contains a <strong>definition </strong>of a posted worker to the territory of Poland (as a “worker hired in another Member State, temporarily sent to work in the territory of the Republic of Poland by the employer posting the worker to the territory of the Republic of Poland; Article 3.6), and a posted worker from the territory of Poland (as a “worker within the meaning of the provisions of the Member State to which he or she is posted, performing work in the territory of the Republic of Poland, temporarily directed to work in the territory of that country by the employer posting the worker from the territory of the Republic of Poland; Article 3.7).</p></li><li data-list-item-id="e22050818ba0ab0a0394a4549c91371d2"><p style="margin: 0; text-align: justify;">Requires that employers posting workers to Poland must provide them with <strong>working conditions</strong> at least as favourable as those guaranteed to employees under Polish labour law, including the Labour Code and other relevant regulations.</p></li><li data-list-item-id="ebbdca93e8c41f72a328e641233dae773"><p style="margin: 0; text-align: justify;"><strong>Ensures the application</strong> of a core set of provisions during the first 12 months (extendable to 18 months with notification) of the posting, regarding all Polish employment conditions, except for contract initiation/termination rules and occupational pension schemes (Article 4b). However, if a worker is posted to Poland for initial assembly or installation work for a period not exceeding 8 days in a year, and this work is necessary for the use of supplied goods, the employer is not required to apply the conditions related to minimum annual leave and remuneration (Article 5).</p></li><li data-list-item-id="e7e403075a86afa2931dc3c55bd9224ea"><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers </strong>equally, including TCNs posted from other EU/EEA States.</p></li></ul><p style="margin: 0; text-align: justify;"><br>The <a href="https://eli.gov.pl/api/acts/DU/2025/621/text/T/D20250621L.pdf" target="_blank" rel="noopener noreferrer"><strong>Act of 20 March 2025 on the conditions for the admissibility of entrusting work to foreigners on the territory of the Republic of Poland:</strong></a></p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="e9edc0a19f11149c30e3041b55c13076d"><p style="margin: 0; text-align: justify;">Regulates that posting TCNs to Poland constitutes a situation of “entrusting work to foreigner”.</p></li><li data-list-item-id="eb64072ae3c10622dfa3531ccf242b8a9"><p style="margin: 0; text-align: justify;"><strong>Regulates issuing work permits in case of posting TCNs to Poland </strong>(Article 6, Articles 40-44).</p></li></ul></div>
