<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><div style="font-family:Segoe UI;font-size:11pt;text-align:justify;">Romanian labour law is primarily governed by the <a href="https://www.inspectiamuncii.ro/documents/66402/266223/2003.l.53.pdf/abedbf7f-f9bb-4676-848d-aa12264c1790" target="_blank" rel="noopener noreferrer">Labour Code</a> <strong>(Codul Muncii, Law No. 53/2003)</strong>, which regulates employment relationships, working conditions, and workers' rights. The <a href="https://static.anaf.ro/static/10/Anaf/legislatie/L_16_2017.pdf" target="_blank" rel="noopener noreferrer">Law on Posting of Workers</a> (Law No. 16/2017) transposes Directive 96/71/ECs (Posting of Workers Directive) and its amendments, ensuring that posted workers, including TCNs, receive equal treatment in fundamental employment conditions while working in Romania. <a href="https://www.inspectiamuncii.ro/documents/66402/1518590/HOT%C4%82R%C3%82RE+nr.+337.pdf/fecc910c-b2d4-4aff-abff-aecb2a0c1511" target="_blank" rel="noopener noreferrer">Government Decision No. 337/2017</a> establishes methodological norms for the application of posting rules.<br> </div><p style="margin: 0; text-align: justify;"><strong>Law No. 16/2017:</strong></p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: initial;"><li data-list-item-id="e8e00569b9257992352f7d85ce7cc7a60"><p style="margin: 0; text-align: justify;"><strong>Regulates employment conditions</strong>, covering various aspects such as: maximum working time and minimum rest periods, minimum paid annual leave, remuneration in the host country, including overtime pay, health and safety at the workplace, protection for pregnant workers and young workers, equal treatment between men and women, non-discrimination, conditions of accommodation when provided by the employer, and reimbursement of travel, accommodation, and meal expenses. It also sets out specific rules on certain aspects of the posting of drivers in the road transport sector.</p></li></ul><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: initial;"><li data-list-item-id="e6bfe2b3727c0d7197b76002e0b145303"><p style="margin: 0; text-align: justify;"><strong>Obliges the home employer</strong> to pay the posted employees a posting allowance to cover their social protection, granted in view of compensating the inconveniences caused by the posting (relocating the employee from their usual environment, costs of accommodation, transport and meals incurred with the posting (Article 2(1) letters g and h)).</p></li></ul><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: initial;"><li data-list-item-id="edc929d101e5d0f669197106a6b8756b7"><p style="margin: 0; text-align: justify;"><strong>Defines an ‘employee’</strong> by cross-referencing the notion regulated in the Labour Code (Article 2(2)). The Labour Code does not define ‘employee’, but Article 10 provides that ‘an individual employment contract is a contract under which a natural person, referred to as an employee, undertakes to perform work for and under the authority of an employer, whether a natural or legal person, in exchange for remuneration, referred to as a salary’. </p></li></ul><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: initial;"><li data-list-item-id="e9a817dc63ad4764ceffb1cc753372888"><p style="margin: 0; text-align: justify;"><strong>Defines a posted worker</strong> by differentiating between an employee posted to the territory of Romania and an employee posted from the territory of Romania. An employee posted on the territory of Romania is defined as an employee of an employer established on the territory of a Member State other than Romania or on the territory of the Swiss Confederation, who normally works in a state other than Romania, but who is sent to work for a limited period of time in Romania under a services contract, intra-group posting, or temporary agency work (Article 2(1) letter b). An employee posted from the territory of Romania is defined as an employee of an employer established in the territory of Romania who, for a limited period of time, but not exceeding 24 months, in accordance with Article 12 of Regulation (EC) No 883/2004 on the coordination of social security systems, works in the territory of a Member State other than Romania, or on the territory of the European Economic Area (EEA) or on the territory of the Swiss Confederation, during the execution of the contract concluded with the employer in the other Member State, with the condition that they are not sent to replace another posted person. </p></li></ul><p style="margin: 0; text-align: justify;"> </p><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers</strong>, including TCNs, ensuring that they receive equal treatment in employment conditions. <a href="https://legeaz.net/monitorul-oficial-640-2014/og-25-2014-incadrarea" target="_blank" rel="noopener noreferrer">Government Ordinance No. 25/2014</a> also regulates the employment and posting of foreigners on the territory of Romania.</p></div>
