<div class="ck-content" data-wrapper="true" dir="ltr" style="--ck-image-style-spacing: 1.5em; --ck-inline-image-style-spacing: calc(var(--ck-image-style-spacing) / 2); font-family: Segoe UI; font-size: 11pt;"><p style="margin: 0; text-align: justify;">Slovenian labour law is primarily governed by the <a href="https://pisrs.si/pregledPredpisa?id=ZAKO5944" target="_blank" rel="noopener noreferrer"><strong>Employment Relationships Act</strong></a> (Zakon o delovnih razmerjih. ZDR-1), which regulates employment relationships, workers' rights, and employers’ obligations. It also transposes the Posting of Workers Directive and its amendments into Slovenian law, ensuring that posted workers, including TCNs, receive equal treatment in key employment conditions.</p><p style="margin: 0; text-align: justify;"><br>The <a href="https://pisrs.si/pregledPredpisa?id=ZAKO8529" target="_blank" rel="noopener noreferrer"><strong>Transnational Provision of Services Act</strong></a> (Zakon o čezmejnem izvajanju storitev, ZČmIS-1), which also transposes the Posting of Workers Directive and its amendments into Slovenian law, together with Directive 2014/67/EU on the enforcement of Directive 96/71/EC, as well as Directive (EU) 2020/1057 on the posting of drivers in road transport, regulates the conditions of posting within the EU or EEA/EFTA.</p><p style="margin: 0; text-align: justify;"><br><strong>Employment Relationships Act:</strong></p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="eb877bd0bf7d13a40d01dd3db9aee9600"><p style="margin: 0; text-align: justify;"><strong>Regulates employment conditions</strong> of all workers, including workers posted to and from Slovenia. Article 210 regulates the basis status of <strong>posted workers to Slovenia</strong>, recognising for them the minimum level of rights as regulated by Slovenian labour legislation and sectoral collective agreements, if this is more favourable to the worker, concerning working time, breaks and rest periods, night work, minimum annual leave, payment for work (not just salary), employment contracts for agency workers, health and safety at work, special protection for some categories of workers, and prohibition of discrimination.<strong> Posting of workers from Slovenia </strong>is regulated by Articles 208 and 209. The latter stipulates a number of additional elements to be included in the employment contract of a posted worker (e.g. duration of the posting, amount of salary and currency in which it is to be paid, additional health insurance abroad, other benefits (in cash or in kind) to which the worker is entitled during the posting, conditions of return to Slovenia).</p></li><li data-list-item-id="ea5266dacbdaa2a4143eaf70ae52c4c2c"><p style="margin: 0; text-align: justify;"><strong>Defines a worker</strong> as a natural person who is in an employment relationship based on an employment contract (Article 5(1) of the Employment Relationships Act) or in a relationship that has all the elements of an employment relationship (Articles 4, 13(2) and 18 of the Employment Relationships Act).</p></li><li data-list-item-id="e1ea9a49a5ca62cce48a500b461e9b4cc"><p style="margin: 0; text-align: justify;"><strong>Defines a posted worker </strong>as a worker who is temporarily sent to Slovenia by a foreign employer on the basis of an employment contract under foreign law (Article 210(1) of the Employment Relationships Act).</p></li><li data-list-item-id="e97381372b96ba9202b11412283a49ac3"><p style="margin: 0; text-align: justify;"><strong>Applies to all posted workers</strong>: the Slovenian legislation does not differentiate between posting of EU nationals and TCNs. Once TCNs obtain adequate work permits in Slovenia or in another EU Member State, they enjoy the right to freedom of movement and their employment and social security rights and obligations are equal to those of EU nationals.</p></li></ul><p style="margin: 0; text-align: justify;"><br><strong>Transnational Provision of Services Act:</strong></p><p style="margin: 0; text-align: justify;"> </p><ul style="list-style-position: inside;"><li data-list-item-id="eb768bd004ac511d55e34e2521a82cd68"><p style="margin: 0; text-align: justify;"><strong>Regulates cross-border provision of services</strong> and, in this context, <strong>posting of workers within the EU or EEA/EFTA</strong>. Rules on the cross-border provisions of services of Slovenian employers and self-employed persons<strong> to other EU Member States</strong> are regulated in Articles 4 to 13, providing that TCN workers may only be posted to other Member States if they possess a valid uniform residence and work permit or a temporary residence permit or they have the right to free access to the Slovenian labour market (Article 6(8)). In turn, Articles 14 to 19 regulate the cross-border provision of services of foreign employers and self-employed persons<strong> in Slovenia</strong>.</p></li><li data-list-item-id="e0dc4a676306b233ea436d91a79f035e1"><p style="margin: 0; text-align: justify;"><strong>Defines a posted worker</strong> as any natural person, irrespective of nationality, who temporarily or habitually performs work in other EU Member States in connection with the cross-border provision of services provided by an employer or a foreign employer for whom they work (Article 3, point 7). </p></li></ul></div>
